The lawyers also requested that the judge not sentence Trump during litigation over the removal notice. They cited a recent Supreme Court ruling that suggests prosecutors cannot use evidence related to official acts in a case based on unofficial conduct. To move a state criminal case to federal court, a person must be a federal officer and show that defenses are based on the U.S. Constitution or statutes. Trump’s legal team is also arguing that he should not be sentenced until the removal notice is litigated, as the statute prohibits conviction before remanding to state court. The Manhattan district attorney’s office has not yet responded to these latest filings. The hush money case Trump was convicted in involves payments made to Stormy Daniels during the 2016 presidential campaign. Trump’s attorneys have also requested a delay in sentencing until after the November presidential election, which the judge has not yet ruled on.
